By downloading, installing, or using Artify ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Artify ("we," "us," or "our").

2. Description of Service

Artify is an AI-powered art generation application that allows users to create digital artwork using text prompts and various artistic styles. The service includes:

• AI-based image generation
• Multiple artistic styles and filters
• Image saving and sharing capabilities
• Cloud storage for Pro subscribers
• Regular updates and new features

3. User Accounts

Account Creation

• You must be at least 13 years old to use Artify
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access

Account Responsibilities

• You are responsible for all activities under your account
• You may not share your account with others
• You may not use another person's account without permission

4. Subscriptions and Payments

Free Tier

• Limited to 5 daily credits
• Basic features and art styles
• Standard resolution exports
• Watermarked images

Pro Subscriptions

• Pro Monthly: $9.99 per month
• Pro Annual: $79.99 per year
• Unlimited generations
• All features and art styles
• High-resolution exports without watermarks

Billing

• All payments are processed through Apple's App Store
• Subscriptions auto-renew unless cancelled
• Cancel at least 24 hours before renewal to avoid charges
• No refunds for partial subscription periods

5. User Content and Conduct

Content Ownership

• You retain ownership of content you create
• You grant us a license to store and display your content within the app
• Pro users have full commercial rights to their creations
• Free users may use content for personal, non-commercial purposes only

Prohibited Content

You may not create or attempt to create content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights
• Contains explicit adult content or violence
• Promotes hate speech or discrimination
• Impersonates others or is misleading
• Violates any applicable laws or regulations

Prohibited Conduct

You may not:

• Reverse engineer or attempt to extract source code
• Use automated systems or bots to access the service
• Circumvent any security or authentication measures
• Interfere with or disrupt the service
• Attempt to gain unauthorized access to our systems
• Use the service for any illegal purposes

6. Intellectual Property

Our Property

Artify and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Your License to Use

We grant you a limited, non-exclusive, non-transferable license to use the app for personal or commercial purposes (Pro users only) in accordance with these Terms.

7. AI-Generated Content Disclaimer

• AI-generated content may occasionally produce unexpected results
• We do not guarantee the accuracy or appropriateness of generated images
• You are responsible for reviewing and approving content before use
• We are not liable for any consequences of using AI-generated content

8. Privacy

Your use of Artify is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the app and informs users of our data collection practices.

9. Disclaimers and Limitations of Liability

Service Availability

• The service is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• We may modify or discontinue features at any time

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless Artify and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share through the app

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Illegal or harmful activities
• At our sole discretion for any reason

Upon termination, your right to use the service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or via email. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of Artify shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Artify regarding the use of the service.
